Eastern High Court Reconsiders Major Faroese Drug Case That Could Lead to Milder Sentencing

Posted on October 12, 2026

Later this week, it will be revealed whether the High Court will once again hand down a lighter sentence than the Court of the Faroe Islands regarding 5F-MDMB-PINACA, abbreviated as 5F-ADB, a potent synthetic compound used to produce illicit drugs. On Monday and Tuesday, the High Court is hearing the cases of two men who were previously sentenced to 12 years in prison by the Court of the Faroe Islands for smuggling 7.2 liters of 5F-ADB.

When another case involving 5F-ADB was brought before the judiciary previously, the High Court issued a milder verdict than the local trial court. That legal proceeding represented the very first case involving 5F-ADB anywhere in the Danish Realm. In that instance, a man was handed an unconditional prison sentence of one year and ten months by the Court of the Faroe Islands for smuggling 383 milliliters of 5F-ADB along with 50.8 grams of cocaine. Upon appeal, the High Court reduced his prison term by four months.

In an unrelated police action on Saturday, a man was remanded in custody for four weeks after being apprehended at the airport following his arrival from Denmark. Authorities have charged him with possession of 100 grams of hashish, 25 grams of MDMA, and between 5 and 6 grams of ketamine.

This legal proceeding carries substantial weight within the judicial architecture of the Faroe Islands, a self-governing territory within the Kingdom of Denmark. Under this shared legal framework, lower court decisions from the Court of the Faroe Islands in Tórshavn are appealed to the High Court of Eastern Denmark, which periodically convenes in the archipelago to hear appellate matters. The emerging focus on high-potency synthetic cannabinoids like 5F-ADB highlights the evolving challenges facing law enforcement across the North Atlantic nation. Because the archipelago relies heavily on concentrated transport hubs—principally Vágar Airport and the international car ferry route—border security remains the primary frontline against illicit substances entering from mainland Europe and Denmark. As courts weigh the comparative danger and legal status of novel psychoactive substances against conventional narcotics, the High Court’s rulings establish crucial judicial benchmarks for sentencing standards across both the Faroe Islands and the broader Danish Realm.
